Friend commits murder of friend for money

Court awards life-imprisonment to three 
1st Additional Sessions Judge Jammu Mr. Puneet Gupta today awarded life-imprisonment to Surinder Mohan R/o Adarsh Nagar, Jhajjar (Haryana), Romesh Kumar R/o Mandeela Khurd (New Delhi) and Ajay Kumar R/o Uttam Nagar (New Delhi) who are facing trial in a murder case of Ranjan Kumar stated to be close friend of accused Surinder Mohan. 
According to the prosecution case that on December 27, 2000 information was received through reliable source in the P/S Bagh-e-Bahu that an unidentified dead body is lying on the hill near Tawi river. The dead body was of a male age 30/32 years and the body bore injuries marks possibly with sharp edged weapons. A case u/s 302 RPC was registered. The investigation started in the case and identification of the victim was revealed, accused Surinder Mohan was arrested from the Jhajjar. On the alleged disclosure made by this accused, the police arrested co-accused namely Romesh Kumar and Ajay Kumar from Delhi. On the conclusion of the investigation challan was produced against the accused persons for the offences u/s 302 RPC r/w section 4/25 Arms Act. Deceased Ranjan Kumar is stated to be a close friend of the accused Surinder Mohan; both were engaged in obtaining jobs to the people in consideration for money. The deceased along with the accused on December 17, 2000 had planned to go to Jammu as per the evidence collected by the police agency. The deceased and accused are stated to have checked the hotel on December 19, 2002 and left for Patnitop and after visiting Srinagar all these persons again came back to Jammu and stayed in hotel on December 23, 2000 and left the hotel finally in the night hours at about 10:30. The accused Surinder Mohan brought out Rs 4 lacs from the attaché of Ranjan Kumar before leaving the hotel. The deceased and the accused had gone to Harki Poudi Temple near Tawi River at about 8:30 PM. On their way back from the temple the accused Ajay Kumar in order to kill Ranjan Kumar caught hold the deceased and closed his mouth, accused Surinder Mohan and Romesh Kumar attacked with kirch on the vital parts of the body of the deceased and after killing the deceased threw the body below the road, the accused return to hotel at about 9:15 PM. The money which the deceased carried led to his murder by the accused had allegedly recovered by the police during the course of investigation Rs 3, 81, 000/- from the house of accused Surinder Mohan after he made disclosure statement, after completion of the enquiry police presented challan in the court of law.
In the 62 pages judgment 1st Additional Sessions Judge Jammu Mr. Puneet Gupta after hearing both the sides and also gone through the case and witnesses observed that the act was done by the accused with common criminal intention and is proved without fail. Accused persons are therefore, held guilty and convicted for commission of offence u/s 302 RPC r/w section 4/25 Arms Act and further observed that the convicts have snatched the life of a young man who was hardly in his early thirties and had deprived the family of the deceased of his company. He was the bread earner of the family. Deceased Ranjan Kumar was a closed friend of convict Surinder Mohan but this friendship did not fructify and the greed for money coaxed the said Surinder Mohan to kill his friend in cold blooded. In spite of all these circumstances the court is of the considered opinion that the extreme penalty of death sentence is not caught for in the present case, as the accused are not hardened criminals nor any think is brought on record to substantiate this fact, but has happened as happened while courts primarily while awarding sentence take into consideration the theory of deterrence yet the reformation of the accused in further should not be overlooked. With these observations Court life imprisonment to all three accused and also liable to fine of Rs 5000 each u/s 302 RPC. The accused are also sentenced to undergo imprisonment for a period three years and fine Rs 2000 each u/s 25 of Arms Act.
