JK MONITOR: PART-5: CORRUPTION, FAVOURITISM RULE EDUCATION DEPARTMENT IN J&K

adjusted in Jammu district and why not in others. Moreover when
government is trying to rehabilitate Kashmiri Pundits then why they
Fancy Kumari Bhat has been transferred for GHS Ompura Budgam to GHHS
Toph Sherkhania.}
_{On the top of this
list includes the name of a RET/RRET teacher namely Ashwani Kumar from
zone Chowki-Choura of district Jammu has been engaged in the Personal
Section of the Minister of Health and Floriculture. Similary as reported
earlier in the news item of district Kathua we have revealed a name of a
teacher namely Kalpana Sharma is working in the PWD Department of Civil
Secretariat.}

_{CEOs of KISHTWAR, DODA, RAJORI, RAMBAN HAVE DISRESPECTED THE RTI ACT BY NOT PROVIDING THE INFORMATION SOUGHT.}

_{Minimum stay period of a teacher/master must be 2 years at one place and maximum up-to 5 years.}
_{Physically handicap employees must be given some relaxation while adjusting him to any post.}

due to unavoidable circumstance an employee is needed to be
transferred, it must not be done without the proper permission from the
higher authorities/concerned Education Minister of the state.}

is a way out that if after confirmation these RReT should be
transferred vacating the post which can also be helpful in engaging the
next qualified educated person on that post as ReT there. This will also
help in solving many problems like curbing the unemployment, stress and
mental strain due to working at same place from past more than 10 years
and also do not pose too much extra financial burden by recruiting the
teacher through SSRB.}
_{CEO Jammu has
honoured the RTI Act in true sense, and provided the information more
than the expected from the district Jammu. None other district other
than district other than Jammu has provided the information even from
the Government High Schools as well as Government Higher Secondary
Schools. The list of attachments, deployments and transfers is full of
the teachers of other districts of Jammu as well as Kashmir Division who
have managed themselves adjusted in Jammu district.}

JAMMU: Continuing mission against the mess in Jammu and Kashmir Education Department , continuous and back to back disclosures are being made in the stories with an aim and efforts to aware the masses about the poor policies, favroutism and corruption which are adding to suffering of poor school going children thus making mockery of rules and norms besides haplessness and non-seriousness of higher authorities of the department in implementing the rules in letter and spirit.

We are thankful to the state government for implementing the J&K RTI Act as because of this Act we were able to bring these facts before you. But still this law (J&K RTI Act) needs a lot to be implemented in letter and spirit.

We have asked for the complete list of attachments, deployments and transferred ReT/RRT and other employees who are on attachment in the department of school education from the both divisions i.e Kashmir and Jammu. In response to the RTI submitted by Ajmer Alam Wani, the PIO of Kashmir Division has tried their best to accumulate all the data from Kashmir and the pending data if any way got after filing the first appeal to the FAA of Education Department of Kashmir Division.

It took some extra time to collect these figures and possibilities are there that some information may not have been disclosed, but the officials appointed as PIO and FAA made their best efforts to implement the Act in letter and spirit.

Contrary to Kashmir, the situation in Jammu Division was regretful when it comes to implementation of RTI Act in letter and spirit which indicates that administration has least control and command over its subordinates.

From Jammu Division we have got the reply from Poonch, Reasi, Kathua, Udhampur, and Jammu district only. Jammu district has given the detailed information.

The required information from other districts namely Rajouri, Ramban, Kishtawar, Doda, Samba etc is still pending against the RTI application filed by Ajmer Alam Wani on 08/10/2012 even with the lapse of more than 4 months.

In response to the first appeal filed by the RTI Activist Ajmer Alam Wani, a letter from the under Secretary to Govt. of J&K, Department of School Education also forwarded to PIO of Education Department at Directorate office in Jammu vide their letter No:- Edu/NC/SE/449-VI/2012-13 dated; 23/01/2013. The dedication of the staff of the Directorate of School Education Jammu can be judged from here. In response the first appeal filed by the RTI Activist Ajmer Alam Wani, a letter counter signed by the Personal Officer of DSEJ vide their letter number DSEJ/RTI/140-60 dated 15/01/2012 in which RTI Activist was informed to appear for hearing against the appeal filed under RTI, in person on 23/01/2013 at 12:30. This letter was signed by the personal officer on 15/01/2013 but was posted to the RTI Activist on 22/01/2013 via speed post number EE4408188IN which when tracked was booked from Gandhi Nagar Head office at 22:24 (12:24) noon.

The letter on which hearing date was 23/01/2013 at 12:30 was received by the RTI Activist on 23/01/2013 at 2:30 PM due to which the activist could not attend the hearing. This clearly shows that how the employees are dedicated in the implementation of RTI Act. The RTI Activist has now decided to file 2^nd appeal before the Commission if the department fails to provide the pending information.

Now we are here disclosing the pending information lying with us and the information of other districts will be published soon after the same will be received.

Education Department already has a proper transfer policy as per which

1. Mid Session transfers/attachments/deployments should be avoided.

2. Minimum stay period of a teacher/master must be 2 years at one place and maximum up-to 5 years.

The above mentioned rule says that an employees must be transferred after two to five years but the ReT/RReTs are working on the same post from last more than 10 years because of the non availability of proper transfer policy in their favor. Especially the female married folk who are married outside the zone face a lot of problem in performing duties.

Every day they suffer but no one is there to redress their genuine issues. Yet few blue eyed persons have managed to get them self attached or transferred in other districts, with other offices other than Education Department, with ministers. The attachments within the department is quite genuine but how can the adjustments of the employees in other departments like in DC Office, SDM office, Election Cells, In Civil Secretariats, with the Personal Section of ministers can be justified? In our previous reports, many ZEOs said that they are not authorize to attach a ReT/RReT from their actual place of posting still there are hundreds of attachments in almost each and every district of the state. Even they are transferred not only from the zone but also from district.There is a way out that if after confirmation these RReT should be transferred vacating the post which can also be helpful in engaging the next qualified educated person on that post as ReT there. This will also help in solving many problems like curbing the unemployment, stress and mental strain due to working at same place from past more than 10 years and also do not pose too much extra financial burden by recruiting the teacher through SSRB.

NOTE: THE INFORMATION IS STILL AWAITED FROM: CEO, KISHTWAR, DODA, RAJORI, RAMBAN

INFORMATION REVEALED BY CEO POONCH: As per a reply received from CEO POONCH, which says that ReT/RReT cannot be attached or deployed from their actual place of posting and they cannot even be transferred even up-to their next promotion. Moreover as per the letter received vide no: CEO/P/RTI/10620 – 21 Dated 16/11/2012, CEO claimed that there is not even a single case of attachment or deployment of ReTs or RReTs in the District Poonch but the list provided by CEO Jammu has contradicted the claim, which is violation of RTI Act.

INFORMATION REVEALED BY CEO REASI:As per reply of RTI application vide letter number CEO/RSI/RTI/18111-17 Dated 12/12/2012, CEO REASI submitted a list of ZRP/CRP’s showing 12 ReT/RReT/3^Rd teachers are engaged in SSA as ZRP/CRP.

Also as per a letter received vide letter number CEO/Rsi/RTI/18108 – 10 Dated 12/12/2012, CEO has revealed a list of 10 Ret/RReTs and other teachers who are working on attachment, deployment or even transferred. Out of these 10, a teacher namely Mumtaz Bibi who was posted at GMS Khara has been transferred to Jammu Zone.

None other district other than district other than Jammu has provided the information even from the Government High Schools as well as Government Higher Secondary Schools. The list of attachments, deployments and transfers is full of the teachers of other districts of Jammu as well as Kashmir Division who have managed themselves adjusted in Jammu district. There may be the genuine candidates also but who has decided the criteria for their attachment, deployment or transfer. There are more than two hundred employees who are attached/deployed/transferred from their actual place of posting. Interestingly for some employees it is also mentioned that their salary is withdrawn from one post and they are working on some other post.

ON THE TOP OF THIS LIST INCLUDES THE NAME OF A ReT/RReT TEACHER NAMELY ASHWANI KUMAR FROM ZONE CHOWKI-CHOURA OF DISTRICT JAMMU. THE SAID TEACHER HAS BEEN ENGAGED IN THE PERSONAL SECTION OF THE MINISTER OF HEALTH AND FLOURICULTURE. SIMILARY AS REPORTED EARLIER IN THE NEWS ITEM OF DISTRICT KATHUA WE HAVE REVEALED A NAME OF A TEACHER NAMELY KALPANA SHARMA IS WORKING IN THE PWD DEPARTMENT OF CIVIL SECRETERAIT.
There are many other teachers who working either in DC Offices, SDM office, Election Cells, DIET, Cultural Wings etc. If they were employed or engaged for the teaching purpose than what is their role in these offices or departments as mentioned above? And if there need is more DC Offices, SDM office, Election Cells, DIET, Cultural Wings then why should not be permanently relived to those offices so that their services can be utilized their permanently.
Moreover this also vacates the post and this may also provide an employment opportunity to a deserving candidates.
Many of these attachments or transfers has been done on the security grounds but on one hand government, police and Army has been claiming that the situation in the state has improved a lot and peace in ensuring then how these grounds are valid.
And what are the parameters of measuring the threat, how the threat level is measures and what are the grounds are few questions which need attention, and also why these transfers are in maximum made to the summer capital city Jammu, not only from the other districts of the Jammu Division and Kashmir Division.

Moreover when government is trying to rehabilitate Kashmiri Pundits then why they Fancy Kumari Bhat has been transferred for GHS Ompura Budgam to GHHS Toph Sherkhania. Similarly the list shows many more attachments done on the basis of security. This will clearly send a message that our state is still not safe to be visited here.
The other most used reason for the transfer purpose is on the basis of medical grounds. Many employees on the basis of health grounds have managed to transfer themselves in the District Jammu again not only from the districts of the Jammu division but also from the districts of Kashmir division. A employee on detoriated health grounds must either be retired from the services or he/she must be posted somewhere near his house in his parent district. Contrary to this they are transferred, some even along with post, to the district Jammu of Jammu Division. One again fails to understand what type of disease is this, which is cured in Jammu only.

The disclosure of this information by our news agency has also started to show the impact, as the higher authorities has already issued the notification of detachments orders which reads as to cancel all the attachment orders of official/officer issued by DSEK/CEO’S/ZEO’S. Moreover in the dynamic leadership of Honorable Education Minister, Mr Tara Chand who set a time bound goal to streamline the system of education , it has come to our notice that he has now took the necessary steps and measure to clean this mess.

Since the detachments orders have already been issued, but to ensure its implementation in letter and spirit, it needs a personal monitoring and intervention by the Honorable Deputy Chief Minister. Moreover the words of Education Minister i.e rule and law same for all the officials will be Judged here, as all eyes will be on him how he deals with the employees of Education Department who are working in Civil Secretariat, or other Administrative Departments or offices and what will be done with those employees who have managed to get transferred from other districts of the state to Jammu District.

Every burden is not a blessing , ReT/RReTs suffered a lot in terms of non availability of transfer policy and the deployments and transfer of influential ones at their desired place of posting not only within the department but even outside the department. Hope this system of inequality and irregularities established within SSA and RMSA in a systematic manner must end with the personal intervention of Honorable Deputy CM cum Education Minister. Hopes are high from the Education Minister to refresh and revitalize the education system in a systematic manner in which blue eyed are allowed to sit on the heads, leaving the grievance of large folk of education department un-redressed.
